Terms and Conditions of Use of INSTAMONDO.COM

These Terms and Conditions of Use (“Terms”) govern access to and use of INSTAMONDO.COM (the “Service” or the “Website”). By registering for an account, accessing, browsing, or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

2. Eligibility

INSTAMONDO.COM is intended strictly for adults aged 18 years or older.

By registering for or using the Service, you represent and warrant that:

you are at least 18 years old;

you have the legal capacity to enter into a binding agreement;

you will use the Service only in compliance with these Terms and applicable law.

We reserve the right to request proof of age, identity, ownership of profile photos, or other supporting documentation where reasonably necessary for safety, fraud prevention, legal compliance, or payment processor requirements.

If we reasonably suspect that a user is under 18, has provided false age information, or refuses to provide requested verification, we may suspend or permanently terminate the account without notice and remove any related content.

3. Definitions

For the purposes of these Terms:

·Service means INSTAMONDO.COM and all related services, features, content, tools, and functionalities made available through the Website. 

·User means any person who accesses or uses the Service. 

·Account means a registered user profile protected by login credentials. 

·User Content means any information, text, message, image, photo, audio, video, profile information, or other material uploaded, transmitted, or made available by a user through the Service. 

·Credits means virtual, non-monetary units used within the Service for certain features.

4. Registration and Account Responsibility

Registration is free unless specific paid features are purchased. Registration creates a contractual relationship between the user and SC Softio SRL under these Terms.

When registering and maintaining an account, you agree that:

·all information you provide is accurate, current, and not misleading; 

·you will update your information when necessary; 

·you will create an account only for yourself; 

·you will keep your login credentials confidential; 

·you are responsible for all activity that occurs through your account. 

Providing false, incomplete, misleading, or unauthorized information may result in suspension, restriction, or deletion of the account.

If you do not confirm registration by email within 15 days, the account may be deactivated.

If an account remains inactive for more than 12 months, it may be deactivated after prior notice to the user.

5. Paid Services, Subscriptions, and Credits

Certain features of the Service require payment, including but not limited to unlimited messages, audio chat, video chat, private interactions, or other premium functionality.

Payments are processed by external payment service providers. INSTAMONDO.COM does not store or have access to full payment card details. Before payment, the applicable price, package, included features, duration, and any relevant limitations will be clearly displayed.

Subscriptions and packages are personal, non-transferable, and may not be shared with any third party. The Service is intended for personal and private use only.

Credits:

·are an internal service feature only; 

·have no cash value; 

·are not transferable; 

·cannot be exchanged for money; 

·are valid only during the applicable subscription period, unless otherwise stated.

Unused credits are non-refundable.

If you upgrade your subscription, the new package may be combined with the previous one in accordance with the package rules displayed at checkout.

Some packages have limitations. For example, the Emerald package does not allow live chat or video chat. Each package includes virtual credits used for sending messages, private photos, viewing profile visitors, audio and video calls, friend requests and other actions.

If you run out of credits before the end of your subscription period, some features may become unavailable, while other features may remain accessible depending on your package.

The purchase of digital services may result in immediate activation of the purchased features.

Right of Withdrawal

Where applicable under consumer law, the user may exercise the right of withdrawal within 14 days from the purchase of the subscription.

However, where the digital service begins immediately after purchase and the user has expressly consented to such immediate performance, the right of withdrawal may be lost or limited in accordance with Article 16 of Directive 2011/83/EU and applicable Romanian law.

Chargebacks and Payment Disputes

In the event of a chargeback or unjustified payment dispute, INSTAMONDO.COM reserves the right to suspend the relevant account immediately until the matter is resolved.

6. Acceptable Use and Rules of Conduct

While using the Service, you agree to:

·comply with all applicable laws and regulations; 

·respect the rights, privacy, dignity, and safety of other users; 

·use the Service only for lawful personal purposes; 

·provide truthful and non-misleading information; 

·refrain from any activity that harms the Service, its users, or its reputation. 

You must not:

·create fake profiles or impersonate another person; 

·create an account on behalf of another person without their explicit authorization; 

·upload or share content depicting another person without their consent; 

·upload false, manipulated, misleading, or deceptive profile information; 

·use stolen, unauthorized, or misleading images; 

·use deceptive AI-generated, altered, or deepfake content intended to misrepresent identity, appearance, or authenticity; 

·disclose another person’s personal data without authorization; 

·send spam, malware, phishing messages, fraud attempts, or harmful code; 

·publish unauthorized advertisements, promotions, solicitations, or external links; 

·harass, threaten, blackmail, exploit, extort, or intimidate other users; 

·use the Service for illegal, abusive, exploitative, or commercial purposes not expressly authorized by us.

7. Consent, Authenticity, and User Content

You may upload, publish, transmit, or share only content:

·that you own or are legally authorized to use; 

·for which you have all necessary rights, permissions, and consents; 

·that complies with these Terms and applicable law. 

You are solely responsible for the User Content you publish.

It is strictly prohibited to upload, publish, share, request, promote, or distribute:

·content involving or depicting minors or any person who may reasonably appear to be under 18; 

·non-consensual intimate content; 

·content obtained through coercion, exploitation, blackmail, threats, deception, or abuse; 

·sexually exploitative content; 

·content related to trafficking, sexual exploitation, abuse, coercion, or unlawful sexual conduct; 

·manipulated or deceptive content intended to impersonate or mislead others, including misleading AI-generated or deepfake material; 

·any unlawful, defamatory, racist, hateful, violent, or abusive content. 

INSTAMONDO.COM reserves the right to remove content, restrict account functionality, request additional verification, suspend accounts, or permanently terminate accounts where age, identity, consent, authenticity, or legal compliance is in doubt.

8. Nudity and Sexually Explicit Content

INSTAMONDO.COM is an adult dating and communication platform, but it is not a pornography or adult entertainment website.

Public profiles and other publicly accessible areas of the Service must not contain nudity, sexually explicit content, pornographic material, explicit sexual acts, or visible intimate body parts.

Non-explicit profile photos, including standard swimwear photos, may be permitted, provided that they do not contain nudity, explicit sexual content, or otherwise violate these rules.

Any content that violates these standards may be removed immediately and may result in account restriction, suspension, or termination.

Private Communications, Private Webcam, and User Responsibility

INSTAMONDO.COM may provide private communication features between users, including private messaging, private chat, and private webcam interactions.

These features are intended for private communication between users. INSTAMONDO.COM does not market, provide, or sell sexual services, and payments made by users are for access to communication features and platform functionality only, including messages, chat, and private webcam use where available.

INSTAMONDO.COM does not permit the use of the Service for unlawful, exploitative, coercive, non-consensual, or otherwise prohibited conduct, including the sharing of content involving minors, non-consensual intimate content, trafficking-related activity, or sexually exploitative conduct.

Where private communications or content are reported, brought to our attention, or otherwise identified as violating applicable law or platform rules, INSTAMONDO.COM reserves the right to investigate, restrict access, suspend or terminate accounts, remove content where possible, preserve relevant records where legally required, and cooperate with competent authorities.

9. Profile Review, Verification, and Moderation

INSTAMONDO.COM may perform manual and automated checks, review reports, and request additional verification in order to reduce fake, misleading, unlawful, or abusive profiles and content, particularly in relation to user profiles and other publicly accessible areas of the Service.

Such checks may relate to:

·age eligibility; 

·profile authenticity; 

·ownership or authorization for uploaded photos or publicly displayed content; 

·fraud prevention; 

·non-consensual content concerns; 

·suspicious or abusive conduct; 

·compliance with payment processor requirements; 

·legal and regulatory obligations. 

Although we may carry out moderation, reviews, and verification measures, the Service cannot guarantee that all information provided by users will always be accurate, complete, or genuine. Private user communications may not be actively monitored in all cases, but reported violations or suspected unlawful activity may still be investigated and acted upon in accordance with applicable law and platform rules.

10. Reporting Abuse and Illegal Activity

Users may report suspicious, abusive, fraudulent, exploitative, or unlawful activity by:

·using the “Report User” function available on the platform; or 

·contacting customers@instamondo.com 

Reports may include, without limitation:

·suspected minors; 

·fake profiles or impersonation; 

·non-consensual content; 

·manipulated or AI-generated deceptive content; 

·threats, coercion, blackmail, or harassment; 

·trafficking, exploitation, or other illegal activity. 

Reports are reviewed within a reasonable time. Serious safety matters may be prioritized for immediate review and action.

INSTAMONDO.COM may:

·remove content; 

·restrict account access; 

·suspend or terminate accounts; 

·preserve relevant records where required by law or necessary for investigations; 

·cooperate with competent authorities or law enforcement agencies.

11. Zero-Tolerance Policy: Exploitation, Trafficking, and Abuse

INSTAMONDO.COM maintains a strict zero-tolerance policy regarding:

·child sexual exploitation; 

·human trafficking; 

·sexual exploitation; 

·coercion; 

·non-consensual sexual content; 

·abuse, harassment, intimidation, or blackmail; 

·use of the Service to facilitate illegal exploitation of any person. 

Any such conduct is strictly prohibited and may lead to immediate account suspension or termination, removal of content, preservation of relevant evidence where appropriate, and cooperation with competent authorities.

12. Safety Advice for Users

For your personal safety, we recommend that you:

·do not immediately share your phone number, address, workplace, or other sensitive personal information; 

·never provide your home address to someone you just met online; 

·use caution before arranging meetings outside the platform; 

·meet only in public places; 

·arrange your own transportation; 

·inform a friend or relative where you are going and when you expect to return; 

·stop communication immediately if you feel unsafe or pressured. 

INSTAMONDO.COM is not responsible for meetings, interactions, or arrangements that take place outside the platform.

13. Messages and Content Retention

For technical, operational, and data protection reasons, messages may be deleted after 30 days, unless longer retention is required:

·by law; 

·for fraud prevention; 

·for payment disputes; 

·for abuse investigations; 

·for cooperation with authorities. 

14. Intellectual Property

All elements of the Service, including but not limited to the logo, graphics, design, software, databases, text, layout, and other materials belonging to INSTAMONDO.COM, are the property of SC Softio SRL or its licensors and are protected by applicable intellectual property laws.

No reproduction, copying, modification, distribution, republication, or commercial exploitation is permitted without prior written authorization.

You retain ownership of your User Content, but by uploading or publishing it through the Service, you grant SC Softio SRL a limited, non-exclusive, revocable, worldwide license to host, store, display, reproduce, and make available such content solely for the purpose of operating, maintaining, securing, promoting, and improving the Service, subject to applicable law and your privacy choices.

15. Limitation of Liability

To the maximum extent permitted by law:

·INSTAMONDO.COM is not responsible for user-generated content; 

·INSTAMONDO.COM does not guarantee that every user profile is authentic, accurate, or compatible with your expectations; 

·INSTAMONDO.COM does not guarantee meetings, relationships, interactions, or results from use of the Service; 

·the Service is provided on an “as is” and “as available” basis; 

·INSTAMONDO.COM shall not be liable for indirect, incidental, special, consequential, reputational, or data-loss damages. 

Where liability cannot be excluded, our maximum liability shall be limited to the total amount paid by the user to INSTAMONDO.COM for the relevant services during the preceding 12 months.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

16. Suspension, Restriction, and Termination

We may suspend, restrict, or terminate access to the Service, with or without notice, if:

·you breach these Terms; 

·we suspect fraud, abuse, unlawful conduct, or safety risks; 

·we receive credible complaints about your conduct or content; 

·age, identity, consent, or authenticity cannot be reasonably verified; 

·required by law, regulation, payment processor obligations, or competent authorities. 

In such cases, refunds are not guaranteed unless required by applicable law.

17. Changes to the Service and These Terms

INSTAMONDO.COM may modify these Terms or suspend, change, or discontinue all or part of the Service.

Where required, changes will be notified in advance. Continued use of the Service after the effective date of updated Terms constitutes acceptance of the revised Terms.

18. Privacy and Data Protection

The processing of personal data is governed by the Privacy Policy of INSTAMONDO.COM.

By using the Service, you acknowledge that your personal data may be processed in accordance with:

·Regulation (EU) 2016/679 (GDPR); 

·Romanian Law no. 190/2018; 

·other applicable data protection laws. 

19. Governing Law and Jurisdiction

These Terms are governed by Romanian law.

Any disputes arising out of or in connection with these Terms shall be subject to the jurisdiction of the competent courts of Iași, Romania, unless mandatory consumer protection law provides otherwise.

Mandatory rights granted to consumers under the laws of their country of residence remain unaffected.
